Welcome to Logic Wave. These Terms of Service ("Terms") govern your use of our applications, websites, and services (collectively, "Services"), including Lunker and any other applications developed by Logic Wave, LLC ("Logic Wave," "we," "us," or "our"). By using our Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

You must be at least 13 years old to use our Services. By using our Services, you represent that you meet this age requirement.

2. Account Registration

To access certain features, you may need to create an account using OAuth authentication (such as Google or Apple sign-in). You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

By posting User Content, you grant Logic Wave a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving our Services.

Responsibility: You are solely responsible for your User Content. You represent that you have all necessary rights to post your content and that it does not violate these Terms or any third party's rights.

Removal: We may remove User Content that violates these Terms or that we find objectionable, at our sole discretion.

5. Intellectual Property

Our Services, including all software, designs, text, graphics, logos, and other content created by Logic Wave, are protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or decompile our software
• Remove any copyright or proprietary notices

6. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Services, you consent to our data practices as described in the Privacy Policy.

7. Third-Party Services

We do not warrant that:

• Our Services will be uninterrupted or error-free
• Defects will be corrected
• Our Services are free of viruses or harmful components
• Information provided through our Services is accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOGIC WAVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Logic Wave, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our Services, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services ceases immediately.

You may terminate your account at any time by following the account deletion process in our apps or by contacting us. Certain provisions of these Terms survive termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice in our apps or sending you an email. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in New Mexico.

14. Dispute Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute informally, you agree that any legal action must be filed within one (1) year after the cause of action arises.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Logic Wave.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
• Assignment: You may not assign these Terms. We may assign our rights without restriction.
